Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the Repoify service. It is incorporated into the Terms of Service and is a material term of that agreement. Violating this AUP is a material breach and may result in immediate suspension or termination.

This AUP exists for a reason worth stating: the people Repoify surfaces are real engineers who did not ask to be contacted. Treating them well is both the right thing and the thing that keeps this product viable.

1. You are the sender

Repoify provides tooling. You decide who to contact, what to say, and why. For every message you send through the Service, you are the sender under applicable law, and you carry the sender's obligations.

You must comply with all laws applicable to your use of the Service, including without limitation:

  • CAN-SPAM Act (US commercial email)
  • Telephone Consumer Protection Act (US calls and text messages)
  • Title VII, the ADA, the ADEA, and all other anti-discrimination law
  • Any state or municipal law governing automated employment decision tools, including bias-audit and candidate-notice requirements
  • Any US state privacy law applicable to you

The Service sources US-based developers and is offered to US-based customers. If your use would take you outside that scope, stop and contact us first.

You must obtain any consent the law requires for the channel you use, such as prior express consent before a call or text message subject to the TCPA, and you must be able to demonstrate your lawful basis for your outreach if asked.

US law does not require a developer's prior permission before you send them a recruiting email. CAN-SPAM is an opt-out regime, not an opt-in one. What it requires is that the message is honest about who sent it, that it offers a working way to stop, and that you stop when asked. The Service is built around that, and Sections 3 and 4 below say how.

3. Outreach requirements

Every commercial message you send through the Service must:

  1. Include a functioning opt-out mechanism that is clear, conspicuous, and free to use. The Service adds one to every message and honours it automatically, platform-wide and permanently. You must not remove or defeat it;
  2. Include a valid physical postal address. The Service adds one. You must not remove or defeat it, and you must keep the address you give us current;
  3. Use accurate and non-deceptive headers, sender names, and subject lines;
  4. Identify itself as a recruiting or commercial message, and not misrepresent your identity, your employer, or the role;
  5. Be relevant to the recipient's professional role.

You must honour every opt-out request within ten (10) business days, and you must not transfer, sell, or reuse the address of anyone who has opted out.

4. Prohibited conduct

You must not:

Toward individuals

  • Harass, threaten, stalk, demean, or repeatedly contact anyone who has asked you to stop
  • Contact anyone about anything other than a genuine professional opportunity
  • Contact an individual using information you obtained from the Service for a purpose unrelated to recruiting
  • Attempt to identify, locate, or contact an individual at a personal address, personal phone number, or personal social account obtained outside the Service
  • Contact anyone who has appeared on a suppression or do-not-contact list

With the data

  • Export, resell, license, sublicense, or redistribute information obtained from the Service to any third party
  • Use the Service to build, train, or enrich a competing database or product
  • Scrape, crawl, or systematically extract data from the Service by automated means
  • Combine Service data with other datasets to build profiles of individuals

In hiring

  • Use the Service, or any output of it, to discriminate on the basis of race, colour, religion, sex, sexual orientation, gender identity, national origin, age, disability, veteran status, or any other protected characteristic
  • Use the Service, or any Output, as a factor in establishing any individual's eligibility for employment, promotion, retention, or compensation, or to take any adverse action against any individual
  • Use the Service as a background check, reference check, employment screening, or candidate assessment, or as a substitute for or supplement to any of them
  • Request from the Service, or attempt to elicit from it, any assessment, rating, or characterisation of an individual's ability, character, qualifications, or fitness for a role
  • Use the Service to screen for or infer protected characteristics

Against the Service

  • Share your seat, or allow anyone other than the named user to access it
  • Circumvent rate limits, quotas, credit accounting, or access controls
  • Reverse engineer, decompile, or attempt to derive source code or models
  • Probe, scan, or test the security of the Service without our prior written permission
  • Use the Service to transmit malware, or for any unlawful purpose

5. Volume and automation

Use must be consistent with normal individual professional use. We may apply rate limits and quotas. Automated or scripted access outside our published interfaces is prohibited. Bulk outreach must remain individually relevant; blasting identical messages to large undifferentiated lists is a violation of this AUP regardless of volume limits.

6. Third-party platform terms

Information in the Service is sourced in part from third-party platforms, including GitHub. Your use of that information must comply with the terms of the platform it came from, in addition to this AUP. You are responsible for familiarizing yourself with those terms.

7. Reporting and enforcement

Report suspected violations, or conduct by a Repoify customer that affects you, to our legal contact address. If you are an individual who has been contacted through Repoify and want to be removed, use https://repoify.com/do-not-contact.

We may investigate suspected violations and may access account content to the extent necessary to do so. We may suspend or terminate access immediately and without notice where we reasonably believe a violation has occurred or where continued use creates legal risk. We may report unlawful conduct to authorities.

We are not obligated to monitor, and our failure to enforce any provision is not a waiver of it.

8. Changes

We may update this AUP. Material changes take effect thirty (30) days after notice, except changes required by law or to address an active threat, which take effect immediately.
